Dealers fall foul of rules

Nine dealers have been banned from the Motor Vehicles Traders Register (MVTR) so far this year and the registrar has recorded a further 11 instances of non-compliance.

The cases have all been because of failure by the individuals to comply with an order of the Motor Vehicle Disputes Tribunal (MVDT). 

An MVTR update issued this week also reveals Duncan Connor, pictured, registrar of motor vehicle traders, has this year cancelled two registrations due to persons being disqualified and imposed two bans to unregistered traders.

Recent actions highlighted in the update include a five-year ban on motor vehicle trading for Nabi Limited, Nazifia Khan, director, and Jameel Sidique, chief executive officer.

The MVTR explains the registrar received a complaint about the business on February 15 this year claiming an MVDT order had not been complied with and it was determined this was a second instance of non-compliance. 

Following correspondence with the trader, they were banned from selling cars for a period of five years from February 15, 2023, and their registration was cancelled as a result.

In a similar case, a complaint was made to the registrar on March 21, 2023, that an MVDT order against YGY Motors Limited had not been complied with and this was also the second time it had happened. 

As a result, YGY Motors Ltd and Zhidong Xu, director, have been banned from motor vehicle trading for five years from January 25, 2023.

A woman was also banned for five years from May 19, 2023, after she was successfully prosecuted for unregistered trading.

The registrar took action after determining this was a second conviction for Jessie Lee Gettins under section 95(1)(a) of the Motor Vehicle Sales Act 2003 within a period of 10 consecutive years.

Another instance of a trader failing to comply with an MVDT order for a second time involved James Brian Bush.

The registrar received a complaint about the matter on August 4, 2023, and imposed a trading ban on Bush for five years from March 23, 2023. His registration as a motor vehicle trader was cancelled.

The MVTR notes that under the Motor Vehicle Sales Act, a ban has effect for a period of five years starting on and from the date of conviction, failure, or matter for which the ban is imposed by the act.
